    she did read the description. and it clearly said that it has a headphone jack, weighs 4.90oz, and other things.
    sorry, but a piece of paper has no headphone jack nor does it weigh 4.90oz

    Here’s one thing. If the ad says Photo only, don’t say it has a headjack, don’t say it weighs 4.90 oz. Don’t say it’s a clamshell. Photos do not have anything of those characteristics, and regardless of whether she got a word in or not, whatever she would be saying would be considered null and void by the evidence.

    Firstly she couldn’t show where it said it was only a picture as the honourable Judge wouldn’t let her get a word in edge-ways as she was too busy shouting at her.

    And I’m not really defending her; of course she was trying to scam someone, she knew full well that some poor sucker who didn’t bother to read the add properly wouldn’t pick up on the fact she wasn’t actually selling the phones. It doesn’t mean that the winning bidder wasn’t an idiot, though

And I can’t imagine a judge so impartial that they’d be unable to see through this woman’s intentions. Would any judge reason that assaulting someone with the intent to kill is not punishable because they didn’t actually manage to kill the person? Intent is admissable in court.

    @kingolofofaston The woman couldn’t even point out exactly WHERE it said in the ad that it was only a photo. And stating the fact that it was only a photo she was selling in the ad would have been too great a risk, because some people do read carefully. At any rate, it was still done with the intention to scam. Why else would someone even CONSIDER selling pictures of cellphones? They aren’t worth even a penny, much less nearly $500.
